1. Service Description
Morder provides an automated SMS replenishment platform for Shopify merchants ("the Service"). The Service connects to your Shopify store via OAuth, analyses customer purchase patterns, and sends automated SMS messages to encourage repeat purchases at optimised replenishment windows.
2. Account Registration
To use the Service, you must:
- Be a Shopify merchant with a valid store
- Provide accurate account information
- Maintain the security of your account credentials
- Be legally capable of entering into a binding contract
3. Fees and Payments
Service fees are billed monthly as selected in your pricing plan. All fees are exclusive of applicable taxes. We may change our fees with 30 days' notice. Late payments may result in service suspension.
Founding member pricing, if applicable, is locked for as long as your account remains in good standing and on the same plan tier.
4. Acceptable Use
- You must comply with all applicable laws, including GDPR, TCPA, and SMS marketing regulations
- You must obtain proper consent before sending SMS messages through the Service
- You may not use the Service to send spam, fraudulent, or misleading messages
- You may not attempt to reverse engineer, hack, or abuse the Service
5. Data Processing
Morder processes Shopify store and customer data as described in our Privacy Policy. By using the Service, you acknowledge that Morder will process customer data on your behalf as a data processor, and you remain the data controller for your customers' information.
6. Limitation of Liability
The Service is provided "as is" without warranties of any kind, either express or implied. Morder shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Our total liability for any claim arising from the Service is limited to the fees you paid in the 12 months preceding the claim.
7. Termination
You may cancel your subscription at any time. Upon cancellation, your account will remain active until the end of the current billing period. After termination:
- Automated SMS sending will stop immediately
- Data will be retained for 30 days, then permanently deleted
- You may export your data within those 30 days upon request
8. Changes to Terms
We may update these terms as the Service evolves. Material changes will be communicated via email at least 14 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated terms.
9. Governing Law
These terms are governed by the laws of Latvia, European Union. Any disputes shall be resolved in the courts of Riga, Latvia.
